General Terms and Conditions for orders placed via www.hand2hand.ch
The general terms and conditions apply to all orders placed and contracts concluded via the online shop of hand2hand.ch (hereinafter referred to as "order").
Hand2Hand reserves the right to change the general terms and conditions at any time. In each case the version of the general terms and conditions valid at the time of the order is authoritative, which cannot be changed unilaterally for this order.
Order, price and payments
1.1 The offer is addressed to natural persons and legal entities. Deliveries are only made to addresses in Switzerland, Germany, Liechtenstein, Austria, France and Italy.
1.2 The offer is valid while stocks last. Price and assortment changes are possible at any time.
1.3 The payment options Twint, Mastercard, Visa, American Express and Paypal are offered. We reserve the right not to accept certain payment methods and to refer to an alternative for each order.
1.4 Payments are accepted in Swiss Francs and Euro. Any transaction costs will be charged to the buyer.
1.5 By completing the purchase process in the online shop - "buy" - the order is binding and will be confirmed immediately by e-mail, whereby the purchase contract becomes valid. The subsequent delivery takes place after receipt of the payment of the full purchase price including any shipping costs. In the case of prepayment, the goods are reserved until the agreed purchase price has been received by us. Delivery will be made immediately after receipt of the purchase price. Payment in advance is expected with the next possible value date after receipt of the order, but at the latest within 7 working days.
Delivery
2.1 The delivery costs depend on the value of the ordered products (minimum order value excluding delivery costs) and the residence of the buyer. For orders within Switzerland and Lichtenstein the following applies: From an order value of CHF 90.00 no delivery costs are charged, otherwise the delivery costs amount to CHF 7.00. For orders from France, Italy, Austria and Germany the following applies: From an order value of EUR 150.00 no delivery costs are charged, otherwise the delivery costs amount to EUR 18.00. The delivery costs are listed as an additional item in the shopping cart and on the invoice.
2.2 We deliver within Switzerland, Germany, Lichtenstein, Austria, France and Italy. The delivery time is normally 2 working days for deliveries within Switzerland and Lichtenstein. The delivery time for Germany, Austria and France is between 4 - 8 working days. The delivery time for Italy is 6-12 working days, but delivery delays are reserved in exceptional cases. Claims for damages due to delayed or omitted deliveries are excluded.
Guarantee
3.1 The buyer must check the delivered goods as soon as possible and report any defects immediately via the web contact form. The offered goods are not new goods, but used goods. If we find major defects in the goods, these are explicitly listed in the respective product information. We exclude all guarantees.
Claims for damages
4.1 Unfortunately, we cannot accept claims for damages due to errors in illustrations, prices and texts. We ask for your understanding.
Return of goods
5.1 The garments may be returned within 14 days of receipt, provided we receive the item in the same condition in which it was shipped. You can return the package to the following address:

The cost of returning the garments is your own responsibility and will not be paid by us.
5.2 You can pack the garment in the box we used for shipping. The initial shipping costs are not refundable.
5.3 Please make sure that the return is sent with package tracking and that you keep the receipt. If the package is lost and you have shipped without tracking, we cannot give you a refund. After we have received your item back, we will refund you the amount immediately.
Liability and further information
6.1 From the time of delivery the products are subject to your liability.
6.2 Ownership of the Products shall not pass to you until all amounts due in respect of the Products, including transport costs, have been paid in full, or upon delivery, should delivery not take place until full payment has been made.
6.3 If any provision of the contract, including these terms and conditions, is or becomes invalid in whole or in part, or if there is an unforeseen gap in the contract, the validity of the remaining provisions or parts of such provisions shall not be affected. The invalid or missing provisions shall be replaced by the respective statutory provisions.
Applicable law and place of jurisdiction
7.1 All legal transactions or other legal relationships with us shall be governed by Swiss law. The UN Convention on Contracts for the International Sale of Goods (CISG) as well as any other international agreements shall not apply. In the case of contracts for a purpose which cannot be attributed to the professional or commercial activity of the beneficiary (contract with consumer), this choice of law shall only apply to the extent that the protection granted by mandatory provisions of the law of the state in which the consumer has his habitual residence is not withdrawn.
7.2 With regard to consumers, the place of jurisdiction is the consumer's Swiss place of residence. In business dealings with merchants, it is agreed that the place of jurisdiction for all legal disputes concerning these terms and conditions and individual contracts concluded under them, including actions on bills of exchange and cheques, shall be our place of business. In this case we are also entitled to sue at the (domicile) place of residence of the customer.
